"At trial, the government took the position that there did not even need to be actual threats—just the potential for unexpected threats—to unleash federal troops on civilians."

Nota Bene:

On February 20, the Department of State announced the designation of Tren de Aragua (TdA), Mara Salvatrucha (MS-13), and five other organizations as Foreign Terrorist Organizations (FTOs) and Specially Designated Global Terrorists (SDGTs). This FTO and SDGT re-designations permits more aggressive action against these groups including disrupting their banking, targeting shell companies, etc.

On March 15, the White House illegally invoked the Alien Enemies Act against Tren de Aragua.

On August 25, Stephen Miller, the president’s homeland security adviser and White House deputy chief of staff, gave an interview to Sean Hannity on Fox News saying: “The Democrat Party does not fight for, care about, or represent American citizens. It is an entity devoted exclusively [his emphasis] to the defense of hardened criminals, gang-bangers, and illegal, alien killers and terrorists. The Democrat Party is not a political party. It is a domestic extremist organization.”

On Sept. 2nd, the Trump administration announced a “lethal strike” against an alleged drug smuggling vessel in the Caribbean. Posting a video of the strike, Trump stated that the attack was “against positively identified Tren de Aragua Narcoterrorists" noting TdA had been designated as an FTO. He also asserted that the strike had occurred in (a) international waters and (b) killed “11 terrorists.”

On the VERY SAME DAY Trump threatened Chicago with a troop deployment in the same Oval Office appearance in which he announced the strike.
