The first question any nominee should get is, "Who won the 2020 election?".

I wouldn't be surprised if both men are being offered very large sums of money as "retirement bonuses".

...maybe speaker's fees for various right wing bar group conventions. Places one could drive their RV...

Of course Clearance Sale and Aleako are going to retire. They don't have any reason to stay. Their legacies are completely buried in corruption, malfeasance, and partisanship.

They can't rehab their reputations at this point in their lives, but they can certainly help fuck over another several administrations by quitting early enough to get two more ugly partisans to replace themselves.

Spite and pettiness are their hallmarks - well, that and completely transparent misinterpretations of established law for partisan gain - so of course they're completely willing to corrupt democracy even further for their corporate masters as they head to the exits.

Wish I could believe that 2 worse judges than uncle Tom and appalling Alito would be next on SCOTUS! But with trump it's inevitable that he'd find the WORST, pirro, Blanche, blondie, Cannon, whom he owes many favors - just a couple of the worst ones he's likely to name. Or more Heritage Fdn anti constitutionalists...

Why are you assuming they wouldn’t just wait until after the November elections, see if the Dems win big, then retire en masse and count on the lame duck GOP Senate to race through confirmation of new justices over Christmas? It’d be highly irregular, make a mockery of precedent and due process, and you know in your heart the GOP would do it in a heartbeat.

Thomas has a massive ego, even by SCOTUS standards. And a big chip on his shoulder. I'd be a little surprised if he stepped down when he's got a chance to be the longest serving "justice" in history.

Allito is even more partisan than Thomas...but would he stand for getting cucked by POTUS? Maybe...but wow, what an emasculating feeling.

It wouldn't be this way if the shithead democowards had not basically bent over and gave him the ability to stack the court with their complacency in the name of "fairness".

What could a publicity campaign accomplish? I don’t expect any retirement announcements unless Democrats win control of the Senate. If that happens, I expect Alito and Thomas to announce their retirements, effective immediately. SCOTUS will have already begun their new term by then, but both of them have experienced health issues and could plausibly claim that their health didn’t permit them to continue. That would leave two months for the current Senate to ram through confirmations of their replacements, just as McConnell did when Ginsberg died. Don’t know how much Dems in the Senate could put the brakes on that, and I don’t expect any help from Thune or any other Republican Senator. Prepare to welcome new SCOTUS Justice Aileen Cannon.

Alina Habba is a couple years younger, and more of a slap to the institution. Plus Cannon already has a job; wasn't Habba's last gig some sorta advisor to Pam Bondi? ...so she's probably available

Once more with feeling: Lauren, the Democrats are not “the left “unless you listen to Fox News and the Supreme Court is not conservative if you listen to Judge Michael Luttig!!

The court needs to be expanded to 13 or 15. That simple. Term limits. Random pulls for cases

Every president gets to nominate two justices, regardless of whether or not any of them retire or die. The Court doesn’t have to have a consistent number of justices - as a matter of fact, it shouldn’t have, if justices recuse themselves when they’re required two. If the Senate doesn’t confirm the nominations, the president keeps nominating until two are confirmed. If he dies before then, his vice president gets the unused picks. If his term ends without having two justices confirmed, he gets to keep making selections - and the new president doesn’t get any until the former president’s are confirmed.

Also split the 9th Court of Appeals. Conservatives have long noted that it's too large & has too big a caseload.

The only way either of these GOP hacks would retire soon is if they think the Dems could gain the senate in the midterms. If so, they must hurry to step down and make way for their heirs. If not, they'll obviously stay put till 2028, even at their advanced ages. They would rather die still on the bench pending the outcome of 2028 than step aside one day sooner.

Never put it past Trump to make it *extremely* advantageous for Alito or, especially,

Thomas to retire. All he needs to do is promise to give them a heads-up about another war, and tell them when to go long on oil futures.

Remember Justice Kennedy who "suddenly" decided to retire. Lots of speculation about what if any pressure had been brought to bear.

Oh dear, this makes me sick to my stomach - such permanent damage. And - what if the (likely much younger) replacements are even worse!

Sara Smith's avatar

The only (very faint) glimmer of hope that I have is that Alto and Thomas are the worst, and they weren’t nominated by Trump. (I do expect him to nominate Judge Cannon, though.)

I can tell you exactly what we should do - stall. Remember McConnell with Obama? Yup, let’s just pretend to be Mitch until 2028…..

Impeach every damn one of them who testified in their nomination hearing that Roe v. Wade was a precedent to be respected and then voted to overturn it.

Sara Smith's avatar

There’s plenty of basis for impeaching a bunch of them other than their decisions. They’ve filed false financial disclosures. They haven’t recused themselves from cases in which they, their family members, or their benefactors have had interests. If Democrats do gain control of the Senate, I’d like to see them start picking them off one by one (through impeachment!!!)

Clarence Thomas is going nowhere. He relishes the opportunity to stay in office as “revenge” against those that voted against him in 1991. He also let it be known that his immediate family lived a very long-time. Alito could step down. He is a bitter angry old man and his law school friends cannot reconcile the Alito they knew and his personality today
