Every conservative on the SCOTUS should be impeached and removed from bench because they refuse to follow the fucking constitution. For example, their authority is restricted to, by Article III, Section 2, to "law and equity" yet they saw fit to "repeal" Roe, a woman's right to abortion.

Then there's their unconstitutional Trump ruling granting Trump "absolute immunity" even though Article II, Section 3 states very clearly that the president "shall take Care that the Laws be faithfully executed".

There is no reason to ever place an "originalist" conservative on the court because they simply interpret the constitution as they see fit, not that it requires any interpretation because it is clearly written.

Every Democrat should be terrified that either of the two worst justices may retire before the midterms. Of course, you know who they are----Thomas and Alito. That would guarantee any Republican who is president having SCOTUS totally on their side! It's bad enough what we have now with 5 in the majority, so if either of the two terrible justices just wait until after midterms, we have a chance to put in one or two of those and thereby, with two elected to once again have a majority, which would bring SCOTUS back to representing a DEMOCRACY!!!! Unless the Democrats expand the Court to 13 justices in the near future and pack the new openings with liberals, this is a lost cause.

If the Democrats get a trifecta in 2028, one measure they should pass is to make judicial appointments lifetime the way British peerages are lifetime. That is leaving the bench should not create a vacancy so that jurists will not be able to influence the judiciary past their lifetimes by choosing what president they retire under.

The alternative is to have fixed intervals at which to add new jurists, based on the average time each jurisdiction serves so as to influence the long-term number of purists at each circuit and district.

Our current conservative justices represent Leonard Leo’s Opus Dei fundamentalist viewpoints, eg catechism…. Your research needs to include, not just identifying the Federalist society, but Leo’s catholic fundamentalist beliefs. Also I highly recommend you read the book, OPUS, to fully understand the misogyny and cult like features of this fundamentalist organization, that is ruling the majority on the SCOTUS.

Someone please help me understand how a SC justice can be "forced" off the court by the president. Obviously, the impeachment process exists but it's about as meaningful as the current presidential impeachment process (to the extent it differs at all). The assertion, 'if Trump wants them out, they're out' makes no sense to me. We're talking about two of the most egomaniacal, power-obsessed culture warriors ever to inhabit the Earth. I get that they worship their orange idol, but the idea that either of these guys will just say 'yes sir' if they really do not want to retire is ludicrous. Why am I wrong?

Do you think the harder the Trump regime tries to push out Alito and Thomas, the harder Alito and Thomas push back against being kicked to the curb?

Thomas already said he wants to be the longest serving SCOTUS justice in history, and what's Alito going to do with the rest of his despicable life if he's not in power and able to lord his theocratic and illiberal beliefs over the entire country?

BTW, this part: "the politics of the Supreme Court have shifted since then. Greenberg argued that the 2022 Dobbs decision made voters more aware of the Court’s impact on their everyday lives"

In 2016, a supreme court seat was basically on the ballot. If Hillary had won, then the court would have been 5 liberal to 4 conservative justices. A titanic shift in power.

But voters thought Hillary was untrustworthy because of emails, and that got us a 6 to 3 court under Trump with no prospect of a liberal court for the next half century or more - unless the court is realigned by adding 4 more seats by a Democratic administration.

People had the chance to reshape the court away from the right wing power base, but due to indifference, ignorance and stupidity they let the chance slip through their fingers. We're all paying the price now.

I flirted with the idea that negative conduct by and reaction to his non-scotus appointees plus the deficient fealty of Gorsuch and Coney-Barrett might chasten him, Purely wishful thinking. Expecting the worst, am guessing he will not disappoint.

Yeah, they don’t seem to ask very much for their souls. Don’t think there’s enough money (or other incentives) in the world to induce me to work for Trump. My stomach isn’t strong enough.

If either or both retire and it looks like D's can retake the Senate -- and then they do take the Senate, after Trump nominees are confirmed -- it will turbocharge D calls to impose term limits and add justices if they win a trifecta in 2028. Both seem to still be in wish-fantasy land now, given centrist Democrats' squishiness, but the prospect of a Trump Court having the final say for the next two-plus decades would change that.

“If Trump wants them out, they’re out”? Really? Am I being naive by still thinking IT DOESN’T WORK LIKE THAT!? How exactly would that happen? It used to be scandal, retirement or death ended a justice’s term. We’re living in a shame-free era so scandal won’t work. Those two old illiberal husks will stay there as long as they damn well please or until Satan calls them home

If one or two justices were to retire, there's the chance that Trump would nominate people, like Aileen Cannon, who could be toxic for Senators in potentially close elections, such as Sullivan in Alaska. And if three or more R Senators lose their seats, in part because of backlash to Trump, will they be willing to confirm one of his SCOTUS nominees between November and January?

Tim_TEC's avatar

They'd never get Loose Cannon through confirmation, but there are plenty of wacko right wingers who are just as bad, like Judge Ho from the 5th circuit.

At this point, it might benefit Dems a bit if Alito and/or Thomas retire this summer and get replaced by some blatantly obvious hack like Emil Bove or Aileen Cannon. It'd make it easier for them to use that confirmation against Republicans in the upcoming midterms and then campaign for Supreme Court expansion in 2028, which is probably the only half-decent fix for the court at the moment.
