Could David Frum explain why the fisherman had no legal recourse fighting regulatory decisions by a government agency but their case still was decided by the Supreme Court?

Under the Chevron decision, the courts must defer to the agency's interpretation of the laws under which the agency is authorized to regulate. That leaves no accountability for an agency that interprets its authorizing legislation in unreasonable ways.
