SPEAKER 1
Hey, guys, it's Tim Miller from The Bulwark here with Andrew Egger, author of our Morning Shots newsletter. We got breaking news from the Supreme Court. They have held that the Trump administration violated the due process rights of Venezuelan migrants last month in its effort to expel them to El Salvador. This guy said previously blocked the effort to...
0:19
to send more migrants to El Salvador. This is consistent with that. Shout out to our man, Mark Joseph Stern, who's given us this reporting, breaking on Blue Sky. Just a couple other things before we get to Edgar here. The Supreme Court did not give a ruling on whether the Trump administration can
0:34
remove migrants under the Alien Enemies Act at all. It's just, they just ruled that the process in which they attempted to do it was against the law. And as I mentioned, they continue to block future deportations under this act. And there is some encouragement that they have upheld this representing the migrants as an entire class.

Trump Deportations Smacked Down By SCOTUS!

30

The Supreme Court ruled against the Trump administration’s push for immediate deportations, allowing a group of immigrants to challenge their removal as a class. Though procedural, the decision marks a meaningful check on Trump’s power, and a rare rebuke, even from justices he appointed. It signals the Court’s resistance to executive overreach and the administration’s threats to defy judicial authority.

Aileen Cannon is my prediction for Trump's next SCOTUS appointment, should he get one.

I would think every speech that he made on his Middle East “tour of corruption” ( as someone put it ) could be used against him in an impeachment trial to remove him from office for violation of his oath, violation of the amendments and all its clauses of the constitution that he was supposed to faithfully uphold, defend and protect against foreign enemies.

Amy Cohen Barrett has demonstrated her Independence and courage like a lot of conservative women in the Trump era. Especially when compared to the gutless GOP men in Congress who voluntarily castrated themselves. They talked a good game on pro-Constitutionalism when a Democrat occupied the White House. But, alas, it was all political and had nothing to do with core values or principles. Every day they occupy our House, is another day they shit on the Bible they swore their oath on. I'm sure the Christian Nationaists will get right on that. /s

All of it is a no-brainer for the Supreme Court justices if they were not so incredibly compromised and corrupt themselves. And I am referring to 2 ( Alito and Thomas ) in particular and one that sits on the fence( Roberts )

I do not understand when it comes to using this alien act, they are illegally using

Or when it comes to birthright citizenship and his executive order to get rid of it from our constitution

Or the violation of the Emollients clause in our constitution that clearly states that the president of the United States she’ll take gifts from foreign countries Kings or princes

I do not understand in regards to the Supreme Court why they are not upfront with their first response, declaring and stating clearly all of these violations and how illegal they are supporting the lower courts instead of taking the cases and NORMALIZING all of these violations with a freaking discussion!!

I just don't get it. Why if they are ruling that it was illegal to send all those people to El Salvador can't they expand their ruling to say they must all be brought back and be afforded due process? This interminable waiting gives this administration time to continue to violate people's rights and wreak havoc on the entire system.

Do you think that the Federalist Society will sue to get their money back on Barrett and Kavanaugh?

Expand full comment
Bruce Lawrence's avatar

Why would they? Kavanaugh has been the perfect avatar of the Federalist Society. The FedSoc is not MAGA - which is why Trump will not be appointing more FedSoc judges in his second term. This time, he's looking for weak yes men, not principled conservatives - just like his cabinet.

Trump's SCOTUS short list? Judge Shapiro & his Florida floozy would be my bets lol.

Who is Judge Shapiro?

Ben Shapiro - the Orange King loves appointing unqualified hacks to any positions lol. SCOTUS Justices do not have to have law degrees.

At the end of the video, Tim and Andrew talked about filling any vacancies on the Supreme Court. I wonder if Trump would pressure Thomas or Alito to go ahead and step down so he himself could install the replacement.

He might try to bully them out, but he doesn’t really have any leverage with them. They both really loooovvve being feted in federalist circles and their “emotional support billionaires” really wouldn’t cater to them anymore so here’s wishing them both health and long life.

I used to think he would, but they’re the only ones ruling in his favor right now! (I disagree with Tim. I think Judge Aileen “Loose Cannon” has the inside track to becoming the next Justice.)

I agree Trump would want to keep Thomas and Alito. But I disagree on Cannon. Her confirmation testimony under Democratic questioning could prove embarrassing to Trump in too many ways. And, who knows - he might need her to hear future cases regarding his crimes in Mar-A-Lago.

That might be too conventional at this point. I think we are at the stage where Caligula is appointing his horse to the Senate. Alex Jones? Are there any MAGA actors who once played a judge in a movie?

Sara Smith's avatar

I thought the nominations of Matt Gaetz, RFK Jr, Pete Hegseth, Tulsi Gabbard, et al were the Caligula’s horse appointments. (Maybe we should start referring to “The Stable” instead of “The Cabinet”.

Civil rights lawyer here: SCOTUS remanding for further proceeding is both mostly regular order and has a beneficial delaying effect. SCOTUS is, I think, playing the long game by seeking to draw out the timelines on the most controversial cases hoping the MAGA movement's threat to the rule of law will be lessened and their rulings have a greater chance of having staying power. It implies some interesting things regarding SCOTUS' read of the moment and the best path forward.

Yes, and (reading between the lines) SCOTUS seems to be suggesting that the plaintiffs (immigrants) have a high likelihood of success on the merits of the case, as injunctive relief wouldn’t be appropriate otherwise.

It’s not surprising that Trump is so vehemently opposed to due process. He’s spent most of his adult life learning firsthand just how much a criminal can get away with if they understand how to leverage it in their favor.

And yet no one else in this country has been afforded as much due process for himself as Donald Trump.
